Fair Land and Resource Settlements...

“Settlement of the land question remains fundamental to the overall success of our Nations in BC. Without adequate access to land and resources our Nations will never reach our full potential.  In addition to sustaining our traditional practices, access to land and access to resources provides our capital – our equity – and therefore our ability to build our economies and support our government.”

Objective/Goal Strategy Action

Determining which First Nation group has the authority to enter into a  ‘rights and title’ agreement.

Determination of ‘proper title holder’ through discussion, negotiation and potentially mediation 

Strategic litigation

  • Tribal, Regional and if appropriate Provincial “title holder meetings” (with partners)
  • Develop tool for community engagement process (internal), a community-to-community process (internal to nation), and nation-to-nation process
  • Work with other PTOs, Federal and Provincial government where appropriate and other organisations

First Nations to have independent resources to mount claims and negotiate

Immediate and fair access to resource revenue sharing

Grants not loans from Crown

  • Identify revenue sharing opportunities
  • Streamline process for completing revenue sharing agreements
  • Lobby BC and Canada

Fair  Land and Resource Settlements

Develop and implement coordinated action strategy, legal and political strategy and an international strategy

Review effectiveness of BC Treaty Process

Review reconciliation agreements, interim measures, and strategic engagement agreements.

Develop approaches to engage  Crown that are inclusive to all First Nations

Determination of what is a ‘fair settlement’

  • Ensure all First Nations have access to settlement precedents (interim and comprehensive)
  • Work collaboratively (e.g. ‘Common Table’ type initiatives - support and work to advance opportunities identified)
  • Support work of First Nations Task Force - Host BCAFN Forums to mandate and move forward coordinated strategies. 
  • Conduct independent research/analysis  of what constitutes a ‘fair settlement’
  • Convene dialogue sessions between First Nations to coordinate and share information & strategize 
    All Chief’s Meetings

Increase First Nation’s opportunities for participation in national initiatives that support fair and just land and resource settlements

Link with national AFN initiatives - coordinate regional efforts with national efforts

Develop strategy around national AFN portfolio of First Nations’ Government & Exercising & Implementing Our Rights –develop and advance innovative approaches with Canada: e.g., to strengthen Specific Claims process/meaningful input into development of Tribunal and its rules, Comprehensive claims review

  • Ensure parity among negotiations in Canada
  • Strengthen ties to other First Nations in Canada
  • Regional Chief/BC Chiefs to continue to chair and participate in national strategy forums which focus on First Nations’ Governance and Exercising & Implementing Our Rights (developing collective political, legal, international, economic and strategic action plans)
  • BCAFN/AFN – role to coordinate, facilitate, advocate and support our Nations. 
  • Ensure adequate resources

Equity in Treatment of Nations when implementing rights and title

Adoption by Canada of the UN Declaration on the Rights of Indigenous People

National Framework for Rights and Title Implementation

Increased coordination between Nations with pre-confederation treaties, numbered treaties, modern treaties and title holders

  • Lobby Federal government
    Establishment of National Framework for implementation of the UN Declaration minimum standards (may require legislation)
  • Attend International forums to ensure awareness of issues and gain support
  • Participation in National Claims forums
